The Terms of our Guest Agreement are intended to help you enjoy a safe, reliable and convenient stay. The Guest Agreement sets out the terms of your booking with us if you have booked a short term rental. Please carefully read the agreement before signing. Thank you for choosing Sandcastle Condominiums and we hope you are looking forward to an enjoyable experience.
For legal and accounting purposes, the person placing the reservation must be the same as the credit/debit card holder. This person is considered to be the guest. All other persons involved with the rental are considered to be the guest's invitees, and all discussion regarding reservation, cancellation, and damage policies will be discussed with the guest, not the guest's invitees. All parties must be 21 years of age or older unless accompanied by a parent. The minimum age requirement for booking is 25 years of age for Spring Break holiday rate periods.
Deposit due upon booking for Short Term Rentals (29 days or less) is the first night with tax. Final payment will be required prior to checking-in to your vacation rental. Personal Checks are not accepted for remaining balance due. Reservation must be guaranteed with a major credit card. If you are paying by credit card, you represent that you are the account holder and/or authorized user of the account. If for any reason Sandcastle Condominiums believes your payment may be refused by the card processor, Sandcastle Condominiums may ask you for a different form of payment. Upon Sandcastle Condominium's request, you will immediately provide another form of payment and adequate proof that you are the account holder or an authorized user on the account used for such payment (such as government-issued ID that matches the same name on the account). Sandcastle Condominiums may cancel your reservation or remove you and all Occupants from the Property immediately if you fail to provide a form of payment that can be validated by Sandcastle Condominiums. We may share your credit card information and other information about you if we suspect fraud.
As a condition to the rental of all vacation properties, Sandcastle Condominiums reserves the right to charge the guest's credit card for any and all uncovered guest/invitee caused losses and damages sustained to the vacation property throughout the duration of their period of occupancy. In the event of any uncovered guest/invitee-caused loss or damage to the vacation property, including, but not limited to, undue cleaning, eviction, service calls, service charges, fines/assessments, repairs or replacements, plus all applicable taxes, Sandcastle Condominiums is hereby granted the right to charge the guest's credit card. By written or electronic endorsement of this agreement, the guest hereby agrees to pay for all such charges, as defined above and on the proceeding pages.
If there are concerns or issues with your rental property, please immediately contact our office (leave a message if there is no answer). No refunds or considerations are given unless we are notified of problems during your stay.
SAFETY AND SECURITY OF THE PROPERTY
Sandcastle utilizes wirst-bands for the safety and security of its guests and owners throughout the property. Upon checking in to the Sandcastle each guest will receive a wristband and will be required to wear the writst-band throughout the entire duration of their stay. This is required in order to verify that only registered guests and owners are enjoying the facilities. All guests are required to wear wrist-bands throughout their stay.
emergencies / maintenance
In the event of a problem getting in the vacation rental or if there are problems with condition or functionality of the vacation rental, please immediately contact the Sandcastle Condominiums office (leave a voice message if there is no answer!) at 361-749-6201. If it is after office hours, we will make every effort to return your call as soon as possible.
Check in is at 4:00 PM. An early arrival may be arranged, pending other reservations and the housekeeping schedule. Please contact us prior to your arrival to make these arrangements. Unless you have specifically arranged for an early arrival time, please do not arrive at the property before your schedule check in time.
departure time/ check out procedures
Check out is at 11:00 AM. Your prompt departure is appreciated so we can prepare the vacation rental for any incoming guests. A late departure may be arranged, pending other reservations and the housekeeping schedule. If you have not arranged for a late check out, you may be charged a fee for each hour beyond 11:00 AM you are still on property, at a minimum of one hour. If the unit has not been vacated by 4:00 PM, a fee equal to the rental rate of one day may be assessed.
In addition to checking out by 11:00AM, the Guest should complete the following steps upon their departure:
- Leave beds unmade, place used towels on the floor
- Be sure to place dirty dishes in dishwasher and start the cycle prior to departure; OR wash, dry and put away all dishes, pots, pans, silverware, and utensils if the dishwasher is not utilized
- Empty refrigerator and clean up spills
- Set air conditioning to 78 degrees in spring/ summer months; set heater to 60 degrees in fall/winter months (if applicable)
- Take bagged trash to proper receptacles on property
- Close all blinds (if applicable)
- Close and lock all doors and windows
weather and UNFORESEEN events
Sandcastle Condominiums does not accept liability for any inconveniences arising from any temporary defects or stoppage in supply of water, gas, electricity or plumbing, damage caused by weather / road conditions, natural disasters, acts of God or other reasons beyond its control. No refunds will be given for any delays or cancellations due to such conditions.
ACTS OF GOD AND CONSTRUCTION NOISE
Neither Sandcastle Condominiums, representative of Sandcastle Condominiums or Owner of individually owned unit shall be liable for events beyond their control which may interfere with Guest's occupancy, including but not limited to Acts of God, acts of governmental agencies, fire, strikes, war and construction noise from nearby sites or the Property. No rebate or refund will be offered in these circumstances.
Power/ weather related cancellation: Sandcastle Condominiums does not issue refunds due to acts of nature such as: weather, road conditions, snow conditions, power outages or forest fires. Daily rental must be cancelled a minimum of 72 hours prior to arrival date for any deposit refund. Monthly reservations must be cancelled at least thirty days in advance of arrival date for possible refund. Monthly cancellation within thirty (30) days will be subject to 50% penalty. There is a non-refundable $25 cancellation fee for each reservation and an non-refundable $15 booking fee.
SUBSTITUTION OF UNIT
On rare occasions, due to ownership changes, properties being removed from rental use or a need for extensive repairs or maintenance and management personnel access to the unit for service or repairs. This shall include, but not limited to regular monthly pest prevention, regular service for air conditioning and appliances. Sandcastle Condominiums shall exercise the right of access in a reasonable manner. This is an associated risk of renting a single-family residence or condo. If a maintenance issue occurs that cannot be fixed in a reasonable amount of time or if the condo is unavailable for any reason as determined in our discretion, and significantly affects your stay; we reserve the right refund at our discretion or offer to relocate you to another unit if available.
Furnishings are subject to change without notice. If you require special furnishings or equipment, please bring them with you.
APPLIANCES AND EQUIPMENT
Follow all posted or normal instructions for appliances, heating and air conditioning, TV's, television equipment, internet equipment or other devices. Sandcastle Condominiums and Owners of individually owned units cannot guarantee against mechanical failure. Do not abuse equipment or alter settings. If you have a problem, please discontinue use and inform Sandcastle Condominiums' staff immediately to prevent damage. We will make all reasonable efforts for efficient repairs. No refunds will be issued for equipment malfunctions.
Number of Guests
Change in number of guests/conduct of guests: guest(s) agrees that more than the number of people stated on the reservation shall not occupy the premises. The rental is not intended for parties, nor gatherings at any time of anyone except those who have paid to occupy the property. Exceptions are made on an individual basis - please contact Sandcastle Condominiums for prior approval. If there is excessive noise or music, any illegal activity, or evidence of violation of these policies, you may be asked to vacate the premise without any refund and additional charges may be assessed. Please inform us of any change in the number of guests before your arrival to avoid these charges and so the unit can be prepared appropriately for your group. No exceptions or refunds are given for changes in the number of guests after your arrival. Maximum Occupancy limits strictly enforces.
EVENTS AND COMMERCIAL PHOTOGRAPHY
Events and commercial photography or filming are prohibited at the Property or any of the individually owned units without our express, written permission. If approved, additional terms and fees may apply. Guests are welcome to reserve the conference room for an additional fee in the event there is an organized gathering (subject to availability-contact Sandcastle Condominiums for more details).
Linens & Towels
Towels, sheets, pillows and blankets are not meant for outside use.
Only registered Sandcastle guests and residents are permitted to use pool. Absolutely no glass containers or pets allowed in pool area. No diving, horseplay or running. There is no lifeguard on duty, so please swim at your own risk. Sandcastle is not liable for any injury. Pool hours are from 10AM-11PM daily. Out of the safety and consideration of other guests, please do not bring inflatables or large floats.
Smoking is not permitted in any Sandcastle Condominiums property. If there is any tobacco smell in the unit after your departure, you will be charged a minimum cleaning fee of $200. Oil lamps and incense are not permitted due to the long-lasting odor. If these policies are violated, there will be a charge for excessive cleaning and any additional costs up to and including replacement of furniture or upholster items if necessary. There is a designated area for smoking by the fish house.
No pets are allowed in any Sandcastle Condominium properties. If any sign of a pet is discovered, then Guest authorizes Sandcastle Condominiums to charge Guest and additional minimum $500 cleaning fee. Any charges owed by Guest may be charged by Sandcastle Condominiums to the Guest's credit card on file in addition to seeking any relief provided by law.
All Children must be accompanied by an adult which includes pool, hot tub and unit balconies. No children under the age of 16 are allowed in the hot tub at any time. The beach and open waters present certain dangers, thus requiring constant adult supervision. There is no lifeguard available at the pool, hot tub or beach. Swim at your own risk. Sandcastle Condominiums or owners of individually owned units are not responsible for accidents, injury or death.
CABLE TV / Internet
Unless otherwise specified, all units are equipped with Digital Cable Television and high-speed Wi-Fi connection where service is available and we will provide you with any required Wi-Fi passwords. Sandcastle Condominiums contracts out the Cable Television and Internet service and has no control over outages caused by the vendor. Sandcastle Condominiums is unable to offer any discounts or refunds due to interruptions outside of Sandcastle Condominiums control.
Do not put any feminine products in the toilet. Plungers are provided if a clog occurs. Please do not pour grease down the drain.

Guest(s) agree that Sandcastle Condominiums reserves the right to enter the rental property at any time for maintenance, repairs, or the enforcement of this Agreement. Guest(s) shall allow maintenance and management personnel access to the unit for service or repairs. This shall include, but not limited to regular monthly pest prevention, regular service for air conditioning, appliances, or water sensors (if applicable). Sandcastle Condominiums shall exercise the right of access in a reasonable manner. This is an associated risk of renting a single-family residence or condo. If a maintenance issue occurs that cannot be fixed in a reasonable amount of time or if the condo is unavailable for any reason as determined in our discretion, and significantly affects your stay; we reserve the right to refund at our discretion or offer to relocate you to another unit if available.
security & safety
Always lock doors and windows when you leave the vacation rental! When you rent the vacation rental, you assume responsibility for it and its contents, as well as your personal property. Always lock the doors and windows when you leave the vacation rental. Sandcastle Condominiums does not assume any responsibility for injuries resulting from your failure to use due caution. Children must be supervised at all times. Candles are not allowed due to fire hazard and city ordinance.
indemnification & hold harmless
While Sandcastle Condominiums and its property owners strive to maintain vacation properties in the finest condition, no guarantees are expressed nor implied regarding suitability or for any particular purpose. All guest(s) and their invitees use the vacation property structures and premises at their own risk. Sandcastle Condominiums and its property owners shall not be held liable or otherwise responsible in any way for injury to any guest and/or their invitees that is caused or permitted to be caused by the intentional or unintentional acts of said guest(s) and/or invitees, or by the failure of structures, appliances, (including hot tubs and bbqs) furnishings, and/or other equipment, whether by malfunction, misuse, acts of god/nature, and/or are otherwise naturally occurring. No guarantees are expressed nor implied as to the suitability of utilities and other services provided to the vacation properties and adjacent structures and premises. No guarantees are expressed nor implied regarding the suitability/compatibility of materials utilized in the construction of the vacation property and/or its contents. Sandcastle Condominiums and its property owners shall not be held liable nor otherwise responsible in any way for allergic reactions to guest(s) or invitees, caused or permitted to be caused by materials utilized in the manufacture of the vacation property and/or its contents, nor from mold and/or airborne spores, nor from pet/animal allergens, nor from chemical agents including, but not limited to appliances, linens, carpeting, utensils, fixtures, hot tubs, and/or other equipment. By written or electronic endorsement of this agreement, guest(s) and invitees hereby agree to forever hold-harmless and indemnify Sandcastle Condominiums and its property owners from and against all claims, demands, loss, liability/responsibility of any kind and character, including cost of defense, arising out of or in any way connected with the guest(s) use of the property.
